The Fourth Amendment of the US Bill of Rights guarantees the right to secure your personal property and communications against unwarranted government searches.

In spite of this Constitutional mandate, the US government has restricted the distribution of technology that would protect Internet communications from online eavesdroping.

This is analogous to a government preventing its citizens from using personal safes at home, locking their office doors at night, or enclosing letters in sealed envelopes, for fear that criminals might use such devices to hide illegal activities.

Restricting the distribution of encryption technology by US companies, while not restricting the import of the same technology by overseas companies, puts US high-tech firms at a commercial disadvantage.

Such restrictions also create an obstacle to the adoption and standardization of digital authentication, signing and rating systems.

Encryption and digital ratings systems would enable parents to control the material their children access on the Internet -- and would allow us to eliminate indiscriminant censorship laws, such as the CDA sponsored by Senator Exon.
